Legal document

Ratification of a power of attorney (שטר הרשאה) before the Beth-din of Egypt.

שלמה בר אברהם of Alexandria, with two witnesses עמאר (?) בר צומיח and נוחים בר מימון, stated that No Amon, in Elul 1350 (Sel.) = 1039 A.D., Beninah daughter of the said Abraham and wife of Joseph b. (blank), באגבוקני, authorized her brother the said Solomon to bring a claim against the said Joseph, with full power of attorney. After hearing the witnesses, the court empowered Solomon to act and appoint אפטרפוסים. Solomon then appointed החזן מוהוב בן שלום הקרוי בן סלים to deal with Joseph.

Deed, in Arabic

beg. missing, apparently the confirmation of a will before the Beth-din hag-gadol, which comprised מר̇ור̇ שרירא ראש מתיבתה and מר̇ור̇ חנניה ר̇ מת̇, and met in Marḥeshwan, 1309 (Sel.) = 998 A.D. at Baghdad בשוקא עתיקא. There appeared before them מ̇ר̇ חביב בן מ̇ר̇ אסמ[עיל] and מר̇ עלי בן מ̇ר̇ דויד אלשאמי, who explained the contents of the will, and נחום בן ר̇ הרון אלבאעלבכי and אברהם הכהן בן סהל בן צגרי. The court ordered the will to be carried out.

Deed, in Arabic

showing that when אברהם אלעטאר בן אבו אלכרם ידיע אבו תותה נ̇ע̇ died, the control of his estate was in the hands of the דיואן אלמוארית. The elders of the congregation then went to the קאצ̇י and petitioned that it should be transferred from the court to the elders, with power to realize. The request was granted, for a consideration of thirty dinars, paid to the Qadi out of the estate. The disposition of the rest of the property is then stated, the residuary legatee being אבו עמראן אלכהן כ̇ג̇ק̇ מרור משה הכהן השר בר ... חלפון הכהן ... נ̇ע̇, who received eighty-three dinars. The end, with the date, is missing.

Probate of a will

obate of a will, in Arabic with a Hebrew introduction, before עלי החבר ב̇ס̇ג̇ בן כ̇ג̇ק̇ מר̇ עמרם נ̇ע̇, showing that the signatories, together with אבו אלעלא יוסף אבן עבר ללה,went to see the late מפרג אבן חסין אבן שעיב before his death, and found him in full possession of his faculties: they certify that the will represents his wishes as to the disposition of his property, and request that it be confirmed.

The names of the witnesses to the will are והי[ב] אבן חסן, אבן אבו יעקוב, נציר ..., ... בן שלימן, משה בן יפת, שלמה אבן חסן.

On the verso משה אלחזן בר יפת certifies to the writing (of the will ?) and עלי הלוי בר עמרם countersigns.

Decision of the Beth-din, in Arabic

stating that they sent a letter to מניה זפתי by the hand of כרים בר מר̇ור̇ עלי נ̇ע̇ דידיע בן אלזלט concerning אבו אלמנא מר̇ור̇ יצחק הזקן בר מר̇ור̇ יהודה הזקן אלדמשקי נ̇ע̇.

When it reached R. Abraham, the dayan of the community at מ̇ז̇ , he after some difficulties ordered אבו אלמנא to pay to כרים six dinars besides the ten dinars promised at Alexandria. Payment guaranteed by ר̇ שלמה הכהן. When Kerim arrived at מ̇ז̇ with the document, Abu'lmuna refused to pay. The ב̇ד̇ decides that he must pay the six dinars, and has written to him accordingly.

Dated at Fostat, in the last decade of Marḥeshwan, 1437 Sel. = 1126 A. D.

Signed by יצחק ביר̇ שמואל הספרדי זכ̇ לח̇ הע̇ הב̇ and חלפון הלוי ביר̇ מנשה נ̇ע̇.

drawn up at מניה זפתא on the Nile, in the middle of Shebat, 1466 (at the end 1471) Sel. = 1155 A.D., by authority of Samuel the Nagid, certifying that the signatories went to תגאר אבנה כלף אלמערוף באבן אלשיגרי, and her husband בועלי בן אבו אלחסן אלמערוף באלטבראני, and were asked to witness that she gave up to her husband her rights in half the house in מ̇ז̇, mentioned in her kethubhah, and other property.
